Amendments to Johnson County Subdivision Regulations Resolution 339

The Board of Johnson County Commissioners held a Public Hearing on Tuesday, June 19, 2007 at 11:00 AM to hear public comments on proposed amendments to the Johnson County Subdivision Regulations and Minor Subdivision Regulations.

At that meeting, public comments were taken and the proposed amendments were adopted via Resolution 339.

The amendments are intended to:

  1. Increase the time period from 14 days to 30 days prior to a Planning and Zoning Commission meeting when a subdivision Sketch Plan, Preliminary Plat or Final Plat and supporting documentation must be submitted to be included on the agenda for that meeting,
  2. Require developers or their representative to submit a completed checklist for each stage of the subdivision process to certify that requirements for each stage have been completed, and amend the existing Sketch Plan, Preliminary Plat and Final Plat checklists in the Johnson County Subdivision Regulations and Minor Subdivision Regulations, and
  3. Add clarifications to text in areas addressing 1. and 2. above.

NOTICE - ACCESS DRIVEWAY PERMITS

If you are building a new driveway to access a county road or changing the use of an existing driveway from agricultural or residential to industrial or commercial, an Access Driveway Permit is required. Permit applications may be picked up at the Johnson County Road and Bridge located at 314 Railway (behind Ace Hardware) Buffalo, WY or by calling (307) 684-2662 to have an application form faxed to you.

AMENDMENT TO THE JOHNSON COUNTY SUBDIVISION REGULATIONS TO ADD REQUIREMENT FOR SUBDIVISION REVIEW FEES

After a Public Hearing on July 5, 2006, the Board of Johnson County Commissioners voted to amend the Johnson County Subdivision Regulations to add a requirement to charge subdivision review fees to developers.  Subdivision review fees will be applicable to all new subdivision applications submitted after July 5, 2006.

ILLEGAL SUBDIVISIONS

     Wyoming State Law prescribes strict penalties for persons creating illegal subdivisions of property as well as those who, under specific circumstances, assist those persons with illegal subdivisions.  Below are excerpts from the Wyoming State Subdivision Statute which define penalties.  Johnson County is committed to enforcing these penalties when state and county subdivision regulations are violated.  Please be aware of the legal requirements before subdividing property.

W.S. 18-5-313.  False statement or misrepresentation; penalty.

Any person who knowingly authorizes, directs or aids in the publication, advertisement, distribution or circulation of any false statement or misrepresentation concerning any subdivision for sale in this or any other state, and every person with knowledge that any such advertisement, prospectus, pamphlet or letter concerning land or any subdivision thereof contains any written statement that is false or fraudulent in any material part or who issues, circulates, publishes or distributes the same or causes the same to be circulated, published or distributed shall upon conviction be imprisoned for a period not to exceed thirty (30) days or be fined not to exceed five hundred dollars ($500.00). Each day of violation constitutes a new offense.

W.S. 18-5-314.  Penalties.

Any person who willfully violates any provision of this article or any rule or order issued under this article, and any person who as an agent for a subdivider, developer or owner of subdivided lands offers for sale any subdivided lands or subdivisions without first complying with the provisions of this article shall upon conviction be fined not more than five hundred dollars ($500.00) or imprisoned in a county jail for not more than thirty (30) days or both. Each day of violation constitutes a new offense.

W.S. 34-12-115.  Selling lots not platted prohibited.

Any person who shall dispose of, or offer for sale, or lease, any lots in any town, or addition to any town or city, until the plat thereof has been duly acknowledged and recorded as provided in this act [§§ 34-12-101 through 34-12-104, 34-12-106 through 34-12-115], shall forfeit and pay fifty dollars ($50.00) for each lot, and part of lot sold, leased or disposed of, or offered for sale.
